Welcome to Kee Properties Platform including its Apps and Website ("collectively referred to as Platform"), operated by Kee Properties ("Kee" "we", "us", "our"). By accessing you ("User", "you", "your") or using the Platform or contacting us directly, you signify your acceptance of this Privacy Policy ("Privacy Policy"), If you do not agree to this Privacy Policy, you should not engage with our Platform, or use our Services.
1. DEFINITIONS
To help explain things as clearly as possible in this Privacy Policy, every time any of these terms are referenced, are strictly defined as:
- Personal Data: means any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
- Cookie: small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
- Customer: refers to the company, organization or person that signs up to use the Kee Service to manage the relationships with your consumers or service users.
- Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit Kee and use the services.
- IP address: Every device connected to the Internet is assigned a number known as an Internet protocol (IP) address. These numbers are usually assigned in geographic blocks. An IP address can often be used to identify the location from which a device is connecting to the Internet.
- Service: refers to the service provided by Kee as described in the relative Terms and on this platform.
- Third Parties: means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
2. PERSONAL DATA
2.1 What isn't considered personal data:
- 2.1.1 Information that has been combined, summarized, or otherwise processed so that it can no longer reasonably be used to identify an individual (aggregated or non-identifiable data);
- 2.1.2 Data from which personal identifiers have been removed (anonymized or de-identified)
2.2 Our Collection and Use of Personal Data
- 2.2.1 We collect certain personal information when you visit our Platform or app, create an account, place an inquiry, respond to a survey, or complete any form. This may include your name or username, phone number, and email address.
- 2.2.2 The personal data we collect, the way we collect it, and how we use it will depend on how you are interacting with us and the type of services you use (e.g., submit a request/inquiry, register for an account, or otherwise contact us or interact with us). We also collect personal data automatically when you interact with our platforms and other services and may also collect personal data from other sources and Third Parties.
- 2.2.3 We may receive information from you as a result of your visits to, and use of, the platform. This information may include information such as your IP address, the type of device you use, the date and time you access the platform, length of time you spend on the platform, your browsing history (recorded by the text and graphics files that compose that page), and the Internet address of the platform from which you redirected to our platform.
- 2.2.4 We may collect your information during the course of our engagement with you and will only use your personal information in accordance with applicable data protection laws. We may obtain this information from a variety of sources, including:
- 2.2.4.1 brokers and government sources;
- 2.2.4.2 from our affiliates and business partners;
- 2.2.4.3 from advertising networks, analytics providers and search information providers.
3. HOW DO WE PROCESS YOUR INFORMATION?
3.1 We will comply with applicable data protection laws that apply to our processing of your personal information, We will:
- 3.1.1 process your personal information in a lawful, fair, transparent and secure way;
- 3.1.2 collect your personal information only for specific, explicit and legitimate purposes as explained to you when collecting your personal information;
- 3.1.3 not use your personal information in any way that is incompatible with those purposes;
- 3.1.4 process your personal information in a manner that is adequate and relevant to the purposes for which we have collected it and limited only to those purposes;
- 3.1.5 keep your personal information accurate and, where necessary, up to date; and
- 3.1.6 keep your personal information in a form that identifies you only as long as necessary for the purposes we have informed you and/or as permitted by law.
4. USES OF PERSONAL DATA
4.1 we use the personal data we collect to:
- 4.1.1 Create and maintain and develop our Services, or new products and Services, and improve existing products and Services;
- 4.1.2 Aggregate information we receive to help understand individual needs, customize our Services and offerings, and provide everyone better Service;
- 4.1.3 Conduct research and analytics designed to understand our customer base and improve and grow our business, products, services, and customer experience;
- 4.1.4 Communicate with you to provide technical or administrative support;
- 4.1.5 Prevent, investigate, and defend against fraud or unlawful or criminal activity, access to, or use of personal data and our data system services;
- 4.1.6 Enforce, investigate, and resolve disputes and security issues and to enforce our Terms of Service and any other contracts;
- 4.1.7 Comply with legal obligations and other governmental demands;
- 4.1.8 Understand your preferences and interests to better serve you on your home-finding journey;
- 4.1.9 Personalize your individual experience to better serve you on your home-finding journey;
- 4.1.10 Provide you with information about other Services we offer in which you may be interested;
- 4.1.11 For any other lawful, legitimate business purpose; and
- 4.1.12 Fulfill any other purpose for which you provide your personal data, or for which you have otherwise consented.
5. WHO MIGHT WE SHARE THIS INFORMATION WITH?
5.1 We may disclose personal information that we collect, or you provide as described in this privacy policy:
- 5.1.1 We may share your personal information with any member of Kee, or subsidiaries, affiliates and holding company, in order to enable you to request our services, understand your preferences, facilitate any service requests, send you information about products and services that may be of interest to you and conduct the other activities.
- 5.1.2 We may use carefully selected Third Parties to perform Services on our behalf or to assist us with the provision of Services to you. For example, we may engage Third Party agents, distribution partners, cloud service providers, IT service providers and other Third Parties to support and facilitate property sales and bookings, property handover, security services, brand promotions, marketing, advertising, communications, to personalize and optimize our service, to analyze and enhance data (including data about users' interactions with our services), and to provide legal, accounting, insurance, audit and other professional services. While providing such services, these Third Parties may have access to your personal information.
- 5.1.3 We may share your personal information with select business partners in sectors including banking, travel, entertainment, lifestyle, and other industries to enable our customer to avail special offers.
- 5.1.4 We may share your personal information with a buyer or successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or sale of all or part of our assets including during bankruptcy, liquidation, or similar proceedings if your personal information is included among the transferred assets.
- 5.1.5 We may share where required or permitted by law with government or regulatory authorities or upon request to comply with any court order, law or legal process.
- 5.1.6 We may share with other companies and organizations for the purposes of fraud protection and credit risk reduction if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others.
6. HOW LONG DO WE KEEP YOUR INFORMATION?
6.1 We keep your information only as long as we need it to provide Kee services to you and fulfill the purposes described in this policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we'll either remove it from our systems or depersonalize it so that we can't identify you.
6.2 Keeping your personal information secure and preventing unauthorized access is of utmost priority to us, and we take all steps reasonably necessary to protect your personal information against any unauthorized access, use, alteration, disclosure or destruction. In addition, we limit access to your personal information to those employees, agents, contractors and other Third Parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.
6.3 Where we have given you, or where you have created a password which is part of our services or allows you to access parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
6.4 Unfortunately, the transmission of information via the internet is not completely secure. We will do our best to protect your personal information, however, we cannot guarantee the security of your information transmitted to our platforms. Any transmission of information made, is done so at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
7. YOUR CHOICES AND RIGHTS
7.1 With respect to your personal information which is held by us and under our direct control, under certain circumstances and under certain applicable data protection laws, you may have the right to:
- 7.1.1 Access your data – request a copy of your personal information that we process about you;
- 7.1.2 Correct your data – request us to amend or update your personal information where it is inaccurate or incomplete;
- 7.1.3 Erase your data – request us to delete your personal information where it is no longer necessary for the purpose(s) for which your information was originally collected;
- 7.1.4 Restrict your data – request us temporarily or permanently to stop processing all or some of your personal data;
- 7.1.5 Withdraw your consent – withdraw your consent at any time to the use of your personal information for a particular purpose (where we have asked you for consent to use your information for that particular purpose). Please take note that in certain circumstances it may be lawful for us to continue processing without your consent if we have another legal basis (other than consent) for doing so.
8. GOVERNING LAW
8.1 This Privacy Policy is governed by the laws of Egypt including the Egyptian Data Protection Act, Law No. 151 of 2020, without regard to its conflict of laws provision. Further, depending on your location, your use of the Platform may also be subject to additional local, national, or international data protection laws, including but not limited to the General Data Protection Regulation (GDPR).
8.2 You consent to the exclusive jurisdiction of the courts in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy.
9. CHANGES TO OUR PRIVACY
9.1 We may need to make changes to this Privacy Policy or our Services from time to time so that they accurately reflect our current Services and policies. Any changes to the Privacy Policy take effect immediately, and in case of any Material Change it will take effect immediately after being notified by us, including but not limited to by email or via the Platform, then if you continue to use the Service, you will be bound by the updated Privacy Policy. If you do not want to agree to this or any updated Privacy Policy, you can delete your account.
10. COOKIES
10.1 Kee uses "Cookies" to identify the areas of our website/app that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website/app but are non-essential to their use. However, without these cookies, certain functionality like videos may become unavailable or you would be required to enter your login details every time you visit the website/app as we would not be able to remember that you had logged in previously. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our website/app correctly or at all. We never place Personally Identifiable Information in Cookies.
11. INFORMATION ABOUT GENERAL DATA PROTECTION REGULATION (GDPR)
We may be collecting and using information from you if you are from the European Economic Area (EEA), and in this section of our Privacy Policy we are going to explain exactly how and why is this data collected, and how we maintain this data under protection from being replicated or used in the wrong way.
11.1 WHAT IS GDPR?
11.1.1 GDPR is an EU-wide privacy and data protection law that regulates how EU residents' data is protected by companies and enhances the control the EU residents have, over their personal data.
11.1.2 The GDPR is relevant to any globally operating company and not just the EU-based businesses and EU residents. Our customers' data is important irrespective of where they are located, which is why we have implemented GDPR controls as our baseline standard for all our operations worldwide.
11.2 THE DATA PROTECTION PRINCIPLES INCLUDE REQUIREMENTS SUCH AS:
- 11.2.1 Personal data collected must be processed in a fair, legal, and transparent way and should only be used in a way that a person would reasonably expect.
- 11.2.2 Personal data should only be collected to fulfill a specific purpose and it should only be used for that purpose. Organizations must specify why they need the personal data when they collect it.
- 11.2.3 Personal data should be held no longer than necessary to fulfill its purpose.
- 11.2.4 People covered by the GDPR have the right to access their own personal data. They can also request a copy of their data, and that their data be updated, deleted, restricted, or moved to another organization.
11.3 WHY IS GDPR IMPORTANT?
11.3.1 GDPR adds some new requirements regarding how companies should protect individuals' personal data that they collect and process. It also raises the stakes for compliance by increasing enforcement and imposing greater fines for breach. Beyond these facts it's simply the right thing to do. At Kee we strongly believe that your data privacy is very important and we already have solid security and privacy practices in place that go beyond the requirements of this new regulation.
11.4 INDIVIDUAL DATA SUBJECT'S RIGHTS - DATA ACCESS, PORTABILITY AND DELETION
11.4.1 We are committed to helping our customers meet the data subject rights requirements of GDPR. Kee processes or stores all personal data in fully vetted, DPA compliant vendors. We do store all conversation and personal data for up to 6 years unless your account is deleted. In which case, we dispose of all data in accordance with our Terms of Service and Privacy Policy, but we will not hold it longer than 60 days.
11.4.2 We are aware that if you are working with EU customers, you need to be able to provide them with the ability to access, update, retrieve and remove personal data. We got you! We've been set up as self-service from the start and have always given you access to your data and your customers data. Our customer support team is here for you to answer any questions you might have about working with the API.
12. REMARKETING SERVICES
12.1 We may use remarketing services. What Is Remarketing? In digital marketing, remarketing (or retargeting) is the practice of serving ads across the internet to people who have already visited your website/app. It allows your company to seem like they're "following" people around the internet by serving ads on the websites and platforms they use most.
13. PRIVACY OF MINORS
13.1 We are committed to protecting the privacy needs of minors and we encourage parents and guardians to take an active role in their children's online activities and interests. We do not knowingly collect information from children and we do not target our platforms to children. If you become aware that a child has provided us with personal information without the parent or guardian's consent, please contact us.
